CDL & DUI in Arizona

A DUI can result in a wide range of criminal penalties and hardships. However, for a person with a commercial driver’s license (CDL), a conviction can be more devastating. 

If a CDL holder is pulled over in Arizona for suspected DUI while operating a commercial vehicle, he/she can get arrested if his/her blood alcohol content (BAC) is at least .04 percent, rather than the legal limit of .08 percent for non-commercial drivers. On the other hand, when a commercial driver is pulled over for suspected DUI while driving his/her personal vehicle, his/her BAC must be at least .08 percent like other non-commercial drivers. 

Unfortunately, a DUI conviction – whether you had been operating a commercial or personal vehicle at the time of the arrest – can still lead to CDL suspension. A first DUI conviction is punishable by CDL suspension for up to one year. 

If a person was transporting hazardous materials in a commercial vehicle at the time of the arrest, then a first-time conviction will result in CDL suspension for up to three years. A second DUI conviction carries a lifetime CDL suspension. 

The following are some of the other criminal penalties associated with a first DUI in AZ: 

  • Minimum jail sentence of 10 days 

  • A fine of at least $1,250 

  • Driver’s license (personal) suspension for at least 90 days 

  • Installation of ignition interlock device (IID)
